Services

The Circuit Clerk is the Clerk of the Circuit Courts and acts as the ex-officio recorder of HEMPSTEAD County. The Circuit Clerk is made up of Domestic Relations, Civil, Criminal, and Juvenile Courts.

Administrative duties of the Circuit Clerk are to maintain a record of all proceedings of the Circuit Courts and to prep the dockets for these Courts. The Circuit Clerk issues summons, warrants, subpoenas and writs as authorized by the Circuit Court for delivery by the HEMPSTEAD County Sheriff or private court-appointed process server. The Circuit Clerk also maintains a file of all cases pending with the Circuit Court, as well as all records of past court cases and their dispositions.

Other Duties: Recording of real estate documents, collection of court fines & fees, collection of child support payments and filing orders of protection.

Divisions

REAL ESTATE:
At this time real estate documents cannot be filed electronically. Documents can be recorded in person, USPS, FedEx, or UPS for processing.

COURT DOCUMENTS:
A large percentage of our court documents are filed electronically through eFlex. For pro se litigants who cannot use the electronic system, please utilize USPS, FedEx, UPS, or hand delivery to deliver the documents to the Circuit Clerk’s Office for processing.

COURT FINES & FEES:
Court fines & fees may be mailed in to: Hempstead Circuit Clerk’s Office PO Box 1420 Hope, AR 71802, or you may make a payment online myfinepayment.com with your credit or debit card. You may also hand deliver your payment to the Circuit Clerk’s Office.

JUVENILE DIVISION:
Hempstead County Circuit Clerk’s office maintains the records for the Juvenile Division of the Circuit Court. Juvenile records are not open to the public. Records may only be accessed by the attorneys of record or by government agencies involved in the case. Any other access must be issued through a Court Order signed by a Circuit Judge.
In the Juvenile Division, proceedings shall be commenced by the filing of a petition with the Circuit Clerk’s Office by the Prosecuting Attorney for family in need of services or
delinquency or the Arkansas Department of Human Services for dependency-neglect.

CHILD SUPPORT PAYMENTS:
Child Support payments can be mailed in via USPS, FedEx, or USP. You may also hand deliver your payments to the Circuit Clerk’s Office for processing. If you have any questions,

LAND RECORDS:
Recording of all deeds, mortgages, & conveyances of lands and buildings lying within Hempstead County. Maps & plats of subdivisions and all records from other counties
concerning land sales or conveyance which affect title in Hempstead County.

OTHER DUTIES:
Other duties include the recording of powers of attorney, liens on real property,
soldiers’ discharges, leases, real estate fixture filing statements, performance bonds and public official bonds. The records of the Circuit Courts are the evidence of their official acts and, therefore, it is necessary that they be accurately recorded and well maintained.
